These terms of use apply to the use of the digital platform fiyaswitch.com and all offered services, including SmartHub IoT Gateway, CloudSync Platform, and Neural Analytics Suite. The platform enables the networking, control, and analysis of devices and data in real time. Changes to the terms will be communicated by email at least 30 days before they take effect.

The user is obliged to keep their access data confidential and not allow unauthorized third parties to access it. Use of the services is only permitted for lawful purposes. It is prohibited to use the platform for the distribution of malware, spam, or illegal content. In the event of violations, we reserve the right to immediately block access.

We guarantee an average platform availability of 99.5% per calendar year, measured against total time. Maintenance work is generally carried out outside business hours and announced in a timely manner. The specific functions of the individual services are listed in the respective product description. There is no guarantee for the permanent availability of certain functions.

We are fully liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. For simple negligence, we are only liable in the event of a breach of essential contractual obligations (cardinal obligations), limited in amount to the typical foreseeable damage. Liability for indirect damages, data loss, and lost profits is excluded to the extent permitted by law.

The processing of personal data is carried out in accordance with our privacy policy and the applicable data protection regulations (GDPR). We use technical and organizational measures to ensure data security, including end-to-end encryption and regular security audits. The user is responsible for the security of their own systems and devices.

The contract for the use of the platform is for an indefinite period and can be terminated by either party with 30 days' notice to the end of the month. In the event of a serious breach of these terms, the contractual relationship may be terminated without notice. After termination, the user's data will be deleted within 90 days, unless there is a legal obligation to retain it.
